Terms of Service

1. Acceptance of Terms
By creating an account on The Breathing Organization platform ("TBO", "we", "us"), operated by THE BREATHING ORGANIZATION (TBO) PTE. LTD., you agree to be bound by these Terms of Service. If you do not agree, please do not use our services. These terms apply to all users, including Breathers (session participants) and Facilitators (certified practitioners).
2. Service Description
TBO provides a digital platform that:
- Connects Breathers with certified Facilitated Breath Repatterning (FBR) facilitators
- Enables session discovery, scheduling, and secure payment processing
- Provides tools for health declarations, pre/post-session check-ins, and session reflections
- Supports facilitator practice management (availability, client tracking, event creation)
- Hosts community hubs for local breathwork communities
TBO is a platform provider — we do not directly provide breathwork sessions, medical advice, or therapeutic services.
3. Account Responsibilities
- You must be at least 16 years of age to create an account.
- You are responsible for maintaining the security of your account credentials.
- You must provide accurate, current information during registration and keep it updated.
- You are responsible for all activity that occurs under your account.
- Notify us immediately at support@thebreathing.org if you suspect unauthorized access.
4. Bookings & Payments
- All payments are processed securely through Stripe. You agree to Stripe's Terms of Service when making payments.
- Prices are set by Facilitators or Hub administrators and displayed at the time of booking.
- By completing a booking, you authorize the stated charge to your payment method.
- Receipts and payment confirmations are sent to your registered email.
- Bundle and package purchases are non-transferable between users unless explicitly stated.
5. Cancellation & Refund Policy
- Cancellation policies are set by individual Facilitators or Hubs and displayed at the time of booking.
- Cancellations made more than 48 hours before the session start time are generally eligible for a full refund.
- Cancellations between 24–48 hours before the session may be subject to a partial rebook fee (typically 25%).
- Cancellations less than 24 hours before the session may not be eligible for a refund, at the Facilitator's discretion.
- If a Facilitator or Hub cancels a session, you will receive a full refund or the option to rebook to an equivalent session.
- Refunds are processed back to the original payment method. Processing time depends on your bank (typically 5–10 business days).
- In the case of group bookings, refunds for attendee tickets are processed to the original booker's payment method.
6. Health Declaration & Safety
6.1 Participation Agreement
Before your first session, you are required to complete a Participation Agreement & Health Declaration. This form collects information about your physical and psychological health to ensure your safety. You must:
- Provide truthful and complete health information.
- Update your health declaration if your circumstances change.
- Disclose any contraindications (heart conditions, epilepsy, pregnancy, psychiatric conditions, etc.).
- Consult your physician before participating if you have any medical conditions.
6.2 Pre-Session Check-ins
You may be asked to complete a brief check-in before each session to communicate your current state to your Facilitator. This information helps the Facilitator adapt the session to your needs and ensure safety.
6.3 Post-Session Reflections
After sessions, you may be invited to share your experience through a reflection form. Participation in post-session reflections is voluntary and helps both you and your Facilitator track your journey.
6.4 Acknowledgement of Risks
Facilitated Breath Repatterning involves sustained, connected breathing patterns that may produce physical and emotional responses including but not limited to: tingling, temperature changes, muscle tension (tetany), dizziness, emotional releases, and altered states of consciousness. By participating, you acknowledge that:
- You understand these potential effects and accept the inherent risks of voluntary participation.
- FBR sessions are not medical treatment, psychotherapy, or a substitute for professional care.
- You can slow down, pause, or stop at any time — you are always in control.
- You release the Facilitator(s) and TBO from liability for adverse effects arising from your voluntary participation.
7. Facilitator Terms
7.1 Independent Status
Facilitators are independent practitioners, not employees, agents, or representatives of TBO. They are responsible for:
- Their own qualifications, certifications, and ongoing professional development
- Appropriate insurance coverage for their practice
- Compliance with local regulations regarding breathwork, wellness services, and business operations
- Safe facilitation practices and duty of care toward participants
7.2 Facilitator Obligations
- Review participant health declarations before sessions and flag contraindications.
- Maintain confidentiality of all participant health and personal information.
- Provide accurate availability, pricing, and session descriptions.
- Honor published cancellation policies.
- Report safety concerns to TBO promptly.
- Complete facilitator debriefs where required for quality assurance.
7.3 Platform Fees
TBO may charge a platform fee or commission on bookings processed through the platform. Current fee structures are communicated to Facilitators upon onboarding and may be updated with reasonable notice.
8. Hub & Organization Terms
- Hubs are community spaces on TBO that may be managed by a local organizer.
- Hub administrators are responsible for the events and content published under their hub.
- Hub administrators may set event templates, pricing, and cancellation policies for events organized through their hub.
- Facilitators operating within a Hub context agree to that Hub's operational guidelines.
9. Intellectual Property
- All platform content, design, code, and branding (excluding user-generated content) belongs to THE BREATHING ORGANIZATION (TBO) PTE. LTD.
- User-generated content (profiles, reviews, images) remains owned by the user, but you grant TBO a non-exclusive license to display it on the platform.
- You may not reproduce, distribute, or create derivative works of TBO's proprietary content without written permission.
- "Facilitated Breath Repatterning" and "FBR" are terms used with the authorization of the technique's originators.
10. Prohibited Conduct
You agree not to:
- Provide false information in your health declaration or account details
- Use the platform for any unlawful purpose
- Harass, abuse, or intimidate other users or facilitators
- Attempt to circumvent platform security or payment systems
- Scrape, copy, or reproduce platform content for commercial purposes
- Share access credentials with others or create multiple accounts
11. Limitation of Liability & Indemnification
11.1 Limitation of Liability
- TBO provides a technology platform for connecting Breathers with independent Facilitators. We are not a healthcare provider, wellness provider, or breathwork practitioner.
- To the maximum extent permitted by applicable law, TBO, its directors, officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the platform, participation in breathwork sessions, or reliance on any information provided through the platform.
- Without limiting the foregoing, TBO is not liable for any physical injury, emotional distress, psychological harm, or health complications arising from participation in sessions facilitated through the platform.
- To the extent any liability cannot be excluded by law, our total aggregate liability shall not exceed SGD 100 or the amount you have paid to TBO in platform fees in the 12 months preceding the claim, whichever is lower.
- Nothing in these terms excludes liability for fraud or any liability that cannot be excluded under Singapore law.
11.2 Indemnification
You agree to indemnify, defend, and hold harmless TBO, its directors, officers, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of the platform or participation in sessions
- Your breach of these terms or any applicable law
- Your provision of inaccurate health information
- Any dispute between you and a Facilitator, Hub, or other user
- Your content or information submitted to the platform
12. Governing Law & Dispute Resolution
- Disputes between Breathers and Facilitators should first be raised with the Facilitator directly.
- If unresolved, you may contact TBO at support@thebreathing.org for mediation.
- These terms are governed by and construed in accordance with the laws of the Republic of Singapore.
- Any disputes that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Singapore.
13. Account Termination
- You may delete your account at any time through the platform settings.
- TBO may suspend or terminate accounts that violate these terms, with notice where practicable.
- Upon termination, your right to use the platform ceases immediately. Data deletion follows our Privacy Policy.
14. Changes to Terms
We may update these terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use of the platform after changes constitutes acceptance of the updated terms. If you do not agree with the changes, you may delete your account.
